Residential swimming pools, hot tubs, and non-portable spas in St. Petersburg containing water over 18 inches deep must comply with the Residential Swimming Pool Safety Act under Florida Statutes Chapter 515 and Florida Building Code Section 424.2.17. Required safety features include a barrier at least 4 feet tall, no openings or footholds that allow a child to climb or pass through, gates that open outward and are self-closing and self-latching with the latch on the pool side, and either a 20-inch barrier-to-water clearance or other approved measures. Approved alternatives include pool covers meeting ASTM F1346, exit alarms on doors leading to the pool, or self-closing self-latching dwelling exit doors. The City inspects barriers as part of pool permit final inspection.
Non-compliant pools cannot pass final inspection and cannot legally be filled. Owners may face misdemeanor charges under FS 515.27 if a pool lacks required barriers and a child is injured.
