Section 16.40.040 of the St. Petersburg City Code regulates location and design of fences but does not require written neighbor consent before installing a fence on or near a shared property line. The fence must be entirely within the owner's parcel unless both neighbors agree to a shared boundary fence. Many St. Petersburg residential subdivisions and the city's design guidance encourage that the finished or smooth side of a fence face outward toward the neighbor or street. Disputes over actual property line locations are civil matters and may require a survey. HOA and deed restrictions may impose stricter neighbor-notification or material rules in addition to the city code.
Encroaching fences may be removed by court order in civil action. City code penalties apply only when the fence violates height, setback, or permit rules under Chapter 16.
