Saratoga County, NY Fence Regulations: Pool Barriers (2026)

Residential pool barriers in Saratoga County are regulated by the NY State Residential Code Appendix G (9 NYCRR Part 1220), applicable statewide including Saratoga Springs, Clifton Park, Halfmoon, Malta, Ballston Spa, Wilton, and all towns. Barriers must be at least 48 inches high measured on the outside (non-pool) side. Openings must not allow passage of a 4-inch sphere (narrower at top of chain link per AG105.2). Gates must be self-closing and self-latching with the latch 54+ inches above grade or inaccessible from outside. If house walls form part of the barrier, all doors with direct access must have alarms (NY Public Health Law §1399-mm, known as 'Graham's Law,' adopted 2006) audible for at least 30 seconds upon opening. New in-ground and above-ground pools over 24 inches deep require a pool alarm detecting entry into the water. Above-ground pools with sides 48+ inches may qualify as barrier if ladder is removable or lockable. Spas with locking safety covers compliant with ASTM F1346 may satisfy barrier rules. Saratoga Springs City Code Chapter 118 incorporates these rules by reference. Building permits required for pool installation through each town's building department. Final inspection includes barrier compliance before the pool can be filled. Violations carry strict liability under NY common law for drowning incidents.
