Under 780 CMR (Massachusetts Building Code) Section 3109 and Newton ordinance, all residential swimming pools (in-ground and above-ground over 24 inches deep) must be enclosed by a barrier at least 48 inches high. Openings cannot allow a 4-inch sphere to pass through, and gates must open outward from the pool with self-closing and self-latching hardware located at least 54 inches above the ground. Above-ground pools with removable ladders can satisfy the barrier requirement when the ladder is secured. Pool covers meeting ASTM F1346 can substitute for barriers in specific configurations. Building permits are required for pool installation, and Inspectional Services conducts final inspections before pool use. Alarm requirements apply to doors leading from the house to the pool.
