Massachusetts General Laws Chapter 148 Sections 26F and 26F1/2 require smoke detectors and carbon monoxide alarms in every residential dwelling. Newton Fire Department conducts mandatory inspections upon sale or transfer of any one-family, two-family, or three-family home, and the seller must obtain a Certificate of Compliance before closing. Requirements include photoelectric smoke alarms within 20 feet of kitchens and bathrooms, combination photoelectric-ionization or dual-sensor alarms elsewhere, hardwired with battery backup in homes built or substantially renovated after 1975, and CO alarms on every level containing a sleeping area and within 10 feet of bedrooms. Sealed 10-year battery alarms are now standard for older homes. Fees for Newton resale inspections are set by ordinance and must be scheduled in advance.
