North Kensington Fence Regulations: Pool Barriers Rules (2026)

Montgomery County enforces pool barrier requirements through DPS under the International Residential Code (IRC) as adopted by Maryland. All residential swimming pools, hot tubs, and spas with water depth over 24 inches must be enclosed by a barrier at least 48 inches high measured from the finished grade on the exterior side. Gates must be self-closing and self-latching, with latches at least 54 inches above grade or on the pool side of the gate. Barrier openings must not allow passage of a 4-inch sphere. The house wall may serve as one side of the barrier if all doors to the pool area have alarms or self-closing mechanisms. Aboveground pools with walls 48 inches or higher satisfy the barrier requirement if ladders are removable or lockable. Maryland COMAR 05.02.11 sets the state minimum standards. DPS requires a barrier inspection before issuing a final pool occupancy approval. Mesh pool safety covers meeting ASTM F1346 may supplement but not replace permanent barriers.
