All pools require a 48-inch minimum barrier with self-closing, self-latching gates per Montgomery County building code. Non-compliant pools may be ordered drained.
Montgomery County building code, which applies in Takoma Park, adopts the International Swimming Pool and Spa Code (ISPSC) and International Residential Code (IRC) requirements for pool barriers. Every outdoor swimming pool, hot tub, or spa must be completely enclosed by a barrier at least 48 inches high. Gates must be self-closing and self-latching with the latch on the pool side at least 54 inches from grade. The barrier must not have openings that allow passage of a 4-inch sphere. Chain link fences used as pool barriers must have no more than 1.75-inch diamond openings. If the house wall serves as part of the barrier, all doors providing direct access to the pool must have alarms or self-closing devices. Above-ground pools with walls at least 48 inches above grade may use the pool wall as the barrier if the ladder is removable or has a lockable gate. Pool covers are not a substitute for barrier requirements. Montgomery County DPS inspects pool barriers as part of the pool permit process. Non-compliant pools can be ordered drained or filled until barriers are installed.
Non-compliant pool barrier: stop use order, potential draining requirement. Building without pool permit: violation with retroactive permit and penalties.
