Under COMAR 10.17.01.21, all residential swimming pools in Rockville must be enclosed by a barrier at least 48 inches in height. The Rockville building code requires a building permit for swimming pool installation, which includes review of the barrier plan for COMAR compliance. The barrier must completely enclose the pool and prevent uncontrolled access. Above-ground pool walls may serve as part of the barrier if they meet the 48-inch height requirement and access ladders are removable or gated.
Pool barrier violations are enforced by the Rockville Permits and Inspections Division. Non-compliant barriers may result in a notice of violation requiring immediate correction. Failure to maintain required barriers creates significant legal liability for the property owner.
