All residential swimming pools, hot tubs, and spas in Oakland County must comply with the Michigan Residential Code Appendix G (AG105), which requires a 48-inch barrier with self-closing, self-latching gates around any pool deeper than 24 inches.
Michigan adopts the International Residential Code Appendix G as Appendix AG of the 2015 Michigan Residential Code (MCL 125.1501 et seq., enforced through PA 230 of 1972). AG105.2 sets out the barrier specifications: minimum 48 inches high (measured from the outside), maximum 2-inch ground clearance, and no openings that allow passage of a 4-inch sphere. Gates must open outward, be self-closing and self-latching, with the release mechanism at least 54 inches above ground (or shielded). Above-ground pools may use the pool wall as the barrier if the wall is at least 48 inches and the ladder is removable or has a locking gate. When the dwelling forms part of the barrier, any door from the house to the pool area must have an alarm or other approved means (AG105.2 #9). Pool permits are issued by each Oakland County municipality's building department, not the County β most charge $150-$400 for residential pool permits.
Failure to provide a code-compliant barrier is a violation of the Michigan Construction Code Act. Local enforcement (Royal Oak, Troy, West Bloomfield, etc.) can issue stop-use orders, require draining the pool, and impose civil-infraction fines from $100-$1,000 plus daily continuing-violation fees.
