San Mateo County applies the California Swimming Pool Safety Act (Health & Safety Code §115920-115929) as amended by SB 442 (2017). New pools, spas, and pools with renovations requiring permits since January 1, 2018 must have a minimum 60-inch barrier (stricter than the 48-inch federal standard) with gates that are self-closing and self-latching with latches at least 60 inches above grade. Openings in the barrier cannot pass a 4-inch sphere. In addition to the enclosure, pools must have at least TWO of the following seven drowning prevention features: removable mesh pool fencing with self-closing/self-latching gate, approved pool safety cover, exit alarms on doors providing direct access to pool, self-closing/self-latching devices on doors, pool alarms, protective devices meeting ASTM F2208, or other approved means. House wall can serve as part of the barrier only if doors meet the alarm/self-closing requirements. Pool drain covers must comply with Virginia Graeme Baker Act. Inspection at final permit required.
Non-compliant barriers: certificate of occupancy denied, pool use prohibited, fines $250-$1,000 per day. Failure to disclose at sale: civil liability. Drowning on non-compliant premises: civil liability and potential criminal negligence under Penal Code §273a.
