Springdale's pool-barrier rules sit at the intersection of three layers. Chapter 91 of the Code of Ordinances (Premises Maintenance Code), Article III General Requirements, Division 3 Swimming Pools, Spas and Hot Tubs (including Section 91-67) addresses enclosures and maintenance. Chapter 22 (Building) incorporates the state-adopted 2021 Arkansas Residential Code Chapter 42 (which is IRC Appendix G) and the 2021 International Swimming Pool & Spa Code with Appendix A. Together these require every outdoor pool, hot tub, or spa over 24 inches deep to be enclosed by a barrier at least 48 inches high measured from the side facing away from the pool, with openings that will not pass a 4-inch sphere and a maximum 2-inch gap at grade. Pedestrian gates must open outward, be self-closing and self-latching, with the latch release at least 54 inches above grade. Where a dwelling wall is part of the barrier, doors leading to the pool need alarms meeting UL 2017 or the pool needs an ASTM F1346 power safety cover. A hot tub with an ASTM F1346 lockable cover is exempt.
An outdoor pool deeper than 24 inches without a 48-inch barrier, a gate without self-closing or self-latching hardware, or openings exceeding the 4-inch-sphere test is a code violation enforced by the Springdale Building and Code Enforcement offices. Penalties include drain orders, daily fines under Chapter 22, and attractive-nuisance civil liability.
