Property-line and trespass disputes that cannot be resolved are handled in Washington County Circuit Court, not by Springdale Code Enforcement. Best practice is to obtain a boundary survey before installation and put any shared-fence agreement in writing.
Building over the property line is not a city code violation but exposes the owner to a private trespass or ejectment action under Arkansas common law. Removing or damaging a shared partition fence without the co-owner's consent can create liability under A.C.A. 2-39-105. Misstating boundary information on a city permit can void it.
