New York State requires pool barriers under the NY Uniform Fire Prevention and Building Code (19 NYCRR Part 1228 - Swimming Pool and Spa Code) for all residential pools, spas, and hot tubs. Minimum barrier height is 48 inches from grade on the exterior side. Openings in the barrier must not allow passage of a 4-inch sphere (below 48 inches) or 1.75 inches (decorative cutouts). Gates must open outward away from the pool, be self-closing, and self-latching with release mechanisms at least 54 inches above grade. Above-ground pools with sides 48+ inches may serve as their own barrier if ladders are removable or lockable. Clarkstown Town Code Chapter 95, Ramapo Chapter 260, Orangetown Chapter 14A, and Haverstraw Chapter 103 adopt these standards. Rockland County Department of Health under the Rockland County Sanitary Code Article VIII requires permits for public/semi-public pools. Pool alarms on doors leading to the pool area are required when the house wall is part of the barrier. Annual inspections may be required in some villages. NY state law supersedes HOA restrictions that conflict with safety barriers.

Drowning incident with non-compliant barrier: potential civil liability, criminal negligence charges, and NY Social Services Law protective proceedings.
