A retaining wall over four feet tall, measured from the bottom of the footing, needs a Pennsylvania Uniform Construction Code building permit and engineered plans. Shorter unloaded walls are usually exempt. Monroe County townships enforce this through the UCC, and steep Pocono lots make drainage a real concern.
Retaining walls fall under the statewide Uniform Construction Code, applied by each township's code official, not the county. A wall four feet or less from the footing to the top, carrying no surcharge such as a driveway or slope above it, generally needs no permit. A taller wall, or any wall bearing a surcharge, requires a building permit and usually a licensed engineer's stamped design. On the graded, sloping lots common around Pocono, Tobyhanna, and Coolbaugh townships, drainage behind the wall is critical, and a wall that redirects stormwater onto a neighbor creates civil liability. In a POA community the architectural committee may also review the wall.
Building a regulated wall over four feet without a UCC permit draws a stop-work order and fines and can be ordered corrected or removed. A wall diverting drainage onto a neighbor invites a civil claim.
