Under the Chicago Building Code, retaining walls exceeding 4 feet in height from the base to the top of the wall require a building permit with plans prepared by a licensed architect or structural engineer. Retaining walls must meet structural load requirements and provide adequate drainage to prevent hydrostatic pressure buildup. In the public way, retaining walls require additional Public Way Use permits. The Zoning Ordinance may impose setback requirements for retaining walls in certain districts. Walls within required setbacks must comply with height limitations for accessory structures.
Building without a required permit can result in fines of $500 to $1,000 per day and a stop-work order. Structural failures or code violations may require demolition and reconstruction at the owner's expense.
