Suffolk County, MA Fence Regulations: Retaining Walls (2026)

Retaining walls are regulated uniformly across Suffolk County under 780 CMR 1807 (Massachusetts State Building Code). A building permit is required for any retaining wall over 4 feet in height measured from the bottom of the footing to the top of the wall, OR any wall of any height supporting a surcharge (e.g., a driveway, building, or slope above). Walls requiring permits must be designed by a registered Massachusetts Professional Engineer with stamped plans addressing soil pressure, drainage, global stability, and surcharge loads. Boston ISD charges permit fees based on wall value (typically $50 minimum + $10 per $1,000 of project value). Chelsea, Revere, and Winthrop have similar fee schedules. Setback requirements apply — walls cannot encroach into required zoning setbacks without a variance. Drainage behind the wall is critical: weep holes or drainage boards with a drain pipe directing water away from neighboring properties. The Conservation Commission has jurisdiction if the wall is within 100 feet of wetlands or a coastal resource area (MGL c. 131, §40). Historic district commissions may require review in Back Bay, Beacon Hill, South End, Charlestown, and other Boston districts.
