Stockton adopts the California Fire Code through SMC Chapter 15.12, which incorporates CFC Section 307 for open burning and recreational fires. Recreational fire pits must not exceed 3 feet in diameter and must be at a minimum 15-foot setback from any structure or combustible material. A means of fire extinguishment (garden hose or fire extinguisher) must be readily available. Portable outdoor fireplaces must be used in accordance with manufacturer instructions and placed on noncombustible surfaces. The San Joaquin Valley Air Pollution Control District (SJVAPCD) adds a critical layer of regulation through Rule 4901 (Residential Wood Smoke Reduction). From November 1 through the end of February, the district issues daily burn-status declarations for each county. On No Burning for All days, all residential wood burning including outdoor fire pits and chimineas is prohibited. Outdoor wood-burning devices like fire pits and chimineas cannot be registered for exemption and are always subject to burn-day restrictions. Residents can check daily burn status at valleyair.org, call 1-800-SMOG-INFO, or use the Valley Air app. Natural gas and propane fire pits are exempt from SJVAPCD burning restrictions and may be used at any time. Violations of burn-day rules carry fines starting at $50 for a first offense.
