A backyard campfire needs no permit if it stays within a metal, stone or masonry-lined pit not exceeding 3 feet in diameter and 2 feet high, sits at least 25 feet from any structure with 20 feet of overhead clearance, uses only charcoal or seasoned firewood, and is continuously attended by someone at least 16. During a DNR Commissioner burn ban or the county's seasonal fire-danger restriction (issued June 30, 2026), all outdoor and recreational fires on DNR-protected and unincorporated land are prohibited.
Igniting a backyard fire during a burn ban, or exceeding pit-size and setback limits, is enforceable by the fire marshal and SWCAA with civil penalties and mandatory extinguishment.
