El Paso requires property owners to maintain a 30-foot defensible space around structures in wildland-urban interface areas and to remove weeds and brush that create a fire hazard.
Chapter 9.40 and the IFC Chapter 49 (Wildland Urban Interface) require property owners to manage vegetation and combustible materials. Grass and weeds must be kept under 12 inches and dead vegetation removed near structures. Homes in the Upper Valley, West Side foothills, and areas adjacent to Franklin Mountains State Park must maintain 30 feet of defensible space free of dead brush, with thinning required for 100 feet during high-fire seasons. The Fire Marshal can issue notices of abatement, and if the owner fails to comply, the city may enter the property to abate the hazard and assess the cost as a lien.
Non-compliance: $100 first notice, $250 repeat. Failure to abate after notice can result in city-performed clearance at the owner's expense plus administrative fees.
