Fire pit rules in Marion County, FL — also called outdoor burning, recreational fire, or open flame ordinances — cover fuel types, clearances, and when burning is allowed.
Contained fire pits, outdoor fireplaces, and outdoor cooking/heating devices burning only vegetative debris or untreated wood are expressly allowed under Florida Forest Service rule 5I-2.006(11) and Marion County Code Sec. 8-35. The fire must be attended and fully smothered before being left unattended.
No separate permit is required for a backyard fire pit or outdoor fireplace in unincorporated Marion County so long as it fits within the recreational open-burning allowance. Fla. Admin. Code 5I-2.006(11) permits open burning of vegetative debris and untreated wood in a campfire, outdoor fireplace, or other contained outdoor heating or cooking device, and Marion County Code Sec. 8-35 lists campfires, outdoor fireplaces, and recreational or ceremonial fires among allowed open burning. Only untreated wood and vegetative material may be burned; trash, paper products, treated lumber, plastics, and similar materials are prohibited. The fire may not create a smoke, soot, odor, heat, or flame nuisance, and Marion County Fire Rescue has the final say on what constitutes a nuisance. Manufactured gas or propane fire features and small cooking fires are generally treated as contained devices under the same rule. During a declared burn ban, even contained recreational fires may be prohibited.
Burning prohibited materials, creating a nuisance, or leaving a fire pit unattended/unsmothered is an open-burning violation enforced by MCFR; an escaped fire carries suppression-cost and misdemeanor liability under Fla. Stat. 590.125.
