Fort Bend County permits recreational and ceremonial fires in unincorporated areas only when wind, distance, and weather conditions protect neighboring structures and roads.
Under TCEQ rules adopted by Fort Bend County, recreational fire pits used for warmth, ceremony, or noncommercial cooking are allowed outside city limits. Fires must be kept downwind or at least 300 feet from any neighboring structure, must begin no earlier than one hour after sunrise, and must end no later than one hour before sunset. Burning trash, leaves, brush, branches, or plant growth in a recreational pit is prohibited. Active burn bans suspend recreational burning entirely.
Violating outdoor burning rules or an active Commissioners Court burn ban is a Class C misdemeanor under Texas law, punishable by fines up to $500 per occurrence in Fort Bend County.
