Under Texas Local Government Code Β§352.051, the Brazos County Commissioners Court may restrict 'skyrockets with sticks' and 'missiles with fins' in unincorporated areas during drought conditions (KBDI 575+). Texas Local Government Code Β§352.953 prohibits fireworks within 5,000 feet of Bryan and College Station city limits, and violations can carry fines up to $2,500. Brazos County issued a 60-day burn ban on February 24, 2026 (effective through April 25, 2026) due to high fire dangers.
Texas Local Government Code Β§352.051 authorizes the Brazos County Commissioners Court β on a Texas A&M Forest Service finding of drought conditions (Keetch-Byram Drought Index reading of 575 or higher) β to restrict the sale and use of restricted fireworks (those classified as 'skyrockets with sticks' and 'missiles with fins' under 26 TAC Β§34.601) in unincorporated areas during designated fireworks seasons (Texas Independence Day, San Jacinto Day, Memorial Day, Fourth of July, Diwali, December/New Year's, and Cinco de Mayo). Violations are Class C misdemeanors. Independent of any drought order, Texas Local Government Code Β§352.953 makes it an offense to discharge fireworks within 5,000 feet of Bryan or College Station city limits without permission of the city; this offense carries fines up to $2,500. Brazos County also enforces outdoor-burning prohibitions under Texas LGC Β§352.081: on February 24, 2026, the Commissioners Court adopted a 60-day burn ban effective through April 25, 2026, citing high fire dangers and drought conditions; the order does not directly prohibit consumer fireworks sales but does ban open burning. Burn-ban exceptions include prescribed burns, public-utility maintenance, natural-gas pipeline operations, planting/harvesting, and burns by certified prescribed burn managers under the Texas Natural Resources Code. Inside Bryan and College Station, city ordinance generally bans the sale, possession, and discharge of fireworks year-round.
