TCA Title 68, Chapter 104 governs fireworks manufacture, sale, and possession. Permissible consumer fireworks (DOT 1.4G) may be sold by licensed retailers from June 20 through July 5 and December 10 through January 2. Sellers must obtain a state permit from the State Fire Marshal. Sales to persons under 16 are prohibited. While the state regulates sales uniformly, TCA 68-104-208 explicitly allows municipalities and counties to enact ordinances regulating or prohibiting fireworks discharge within their boundaries. Bottle rockets and certain aerial devices remain banned statewide.
Selling without a permit or to minors is a Class A misdemeanor with fines up to $2,500 and up to 11 months 29 days jail.
