Indiana Code 22-11-14 preempts local fireworks regulation, allowing consumer fireworks statewide. Cities may only restrict use during certain hours and on private property. Use is permitted between 9am and 11pm daily, extending to midnight on holidays.
Under IC 22-11-14-10.5, Indiana cities and counties cannot ban consumer fireworks but may regulate hours of use on non-holidays. State law allows fireworks discharge between 9:00 a.m. and 11:00 p.m. on any day, extending to 12:00 midnight on June 29 through July 9, December 31, and certain other holidays. On July 4 and other listed holidays, hours extend until 12:00 midnight. Use is restricted to the user's property, property of someone with permission, or a designated discharge area. Fireworks must be APA 87-1 certified consumer-grade. Sales require state certification; purchase tax is 5%.
Discharging outside permitted hours or locations is a Class C infraction (up to $500). Setting fires causing damage may be Class A misdemeanor with fines up to $5,000 and one year jail.
