New York Penal Law Β§270.00 prohibits the sale and use of consumer aerial fireworks (firecrackers, Roman candles, bottle rockets, aerial shells). Chapter 371 of the Laws of 2017 authorized 'sparkling devices' (ground-based sparklers, fountains, party poppers, snappers) outside NYC and allowed counties to opt out. Ulster County did NOT opt out, so sparkling devices are legal to purchase and use by persons 18+. Seasonal sales are permitted June 1-July 5 and December 26-January 2 from approved tents/stands. Aerial fireworks remain illegal year-round.
Selling illegal fireworks: Class B misdemeanor (up to 90 days jail, $500 fine); selling $500+ worth or to minors: Class A misdemeanor (up to 1 year, $1,000). Possession/use of aerial fireworks: violation-level offense with confiscation.
