All fireworks, including state-classified safe-and-sane devices, are prohibited in unincorporated Napa County under Napa County Code Chapter 8.28 (Fireworks). California Health and Safety Code 12500-12728 separately prohibits dangerous fireworks statewide, and no Napa County jurisdiction has authorized safe-and-sane sales by ordinance.
Napa County Code Chapter 8.28 makes it unlawful to sell, possess, store, use, or discharge fireworks of any kind in the unincorporated areas of the county. California Health and Safety Code Section 12541 only permits safe-and-sane fireworks where a local ordinance specifically authorizes them, and Napa County has not done so, making cone fountains, sparklers, and other safe-and-sane devices illegal alongside firecrackers, mortars, and aerial shells already banned under HSC 12677. The ban reflects extreme wildfire exposure: the October 2017 Atlas Fire burned 51,624 acres and destroyed 783 structures, and the 2020 Glass Fire destroyed 1,555 structures including Meadowood Napa Valley and several wineries. CAL FIRE Sonoma-Lake-Napa Unit, the Napa County Sheriff's Office, and city police departments enforce the ban year-round; enforcement intensifies around July 4 and New Year's Eve.
Possession or use of dangerous fireworks is a misdemeanor under Cal. HSC 12700, punishable by up to one year in county jail and a $1,000 fine. Possession of 25-100 pounds is up to $5,000 (HSC 12702); over 100 pounds is a felony with up to $50,000 in fines. Cal. HSC 13009 makes any person whose fireworks start a wildfire civilly liable for suppression costs.
