In cities with a population over one million (i.e., NYC), the definition of 'dangerous fireworks' is expanded to include sparklers over 10 inches long or 1/4 inch in diameter, making virtually all consumer fireworks illegal in Queens. Possession or use of fireworks is a violation punishable by up to 15 days in jail. Selling or furnishing fireworks is a Class B misdemeanor (up to 90 days). Selling fireworks valued at $500+ is a Class A misdemeanor (up to 1 year). Despite the ban, illegal fireworks are a persistent issue in Queens, particularly around July 4th and during cultural celebrations in the borough's diverse neighborhoods. The NYPD and FDNY conduct enforcement operations.
