O.C.G.A. 25-10-1 through 25-10-10 governs consumer fireworks in Georgia. HB 110 (2015) and SB 350 (2016) legalized consumer fireworks and preempted local prohibition ordinances. Cities may regulate hours of use but cannot ban fireworks outright. Permitted use hours are 10:00 AM to 9:00 PM most days, extending to 11:59 PM on July 3-4 and December 31, and 1:00 AM on January 1. Local governments may extend hours by ordinance. Fireworks may not be used within 100 yards of nuclear facilities, hospitals, or jails.
Misdemeanor charges apply for use outside permitted hours or restricted areas, with fines up to $1,000 and possible jail time under O.C.G.A. 25-10-2.
