Chapter 79, Article 6 of the Martin County Code addresses fireworks within unincorporated Martin County. Florida Statute 791.08 allows consumer fireworks use only on the three designated holidays β New Year's Eve/Day, Independence Day (July 4), and New Year's Eve (Dec. 31) β without a permit. Public fireworks displays (commercial, professional, sponsor events) require a Fireworks Display Permit issued by Martin County Fire Prevention. Sparklers and 'novelties' allowed by Fla. Stat. 791.01 may be sold and used year-round.
Discharging non-sparkler fireworks outside the three designated state-law holidays without a permit is a 1st-degree misdemeanor under Fla. Stat. 791.06 (up to $1,000 fine and/or 1 year in jail). Unpermitted display operations are misdemeanors and may result in confiscation of fireworks.
