Texas law generally prohibits outdoor burning statewide, with limited exceptions for on-site residential yard waste where no trash collection exists. Cameron County's Commissioners Court can prohibit all outdoor burning during drought or wildfire conditions.
Under TCEQ rule 30 TAC 111.201, no outdoor burning is allowed in Texas except as authorized by the subchapter or by commission orders. Limited exceptions in 30 TAC 111.209 allow on-site burning of yard waste (trees, brush, grass, leaves, branch trimmings) by the property owner, and domestic-waste burning at a private residence where local waste collection is unavailable, subject to 111.219 conditions. Separately, Cameron County's Commissioners Court, acting under Local Government Code 352.081, may by order prohibit or restrict outdoor burning in the unincorporated area during certified drought conditions or a finding of public-safety hazard.
