Senate Bill 762 (2021), codified at ORS 477.490 and related sections, requires Oregon Department of Forestry and Oregon State University to develop and maintain a statewide wildfire hazard map classifying every tax lot as low, moderate, or high hazard within the wildland-urban interface. Properties designated high hazard within the WUI become subject to statewide defensible space standards under ORS 477.046 and to building code home-hardening requirements adopted under ORS 455.612 by the Building Codes Division. Failure to maintain required defensible space within designated hazard zones may result in state-imposed corrective action and cost recovery under ORS 477.062, plus potential liability for fire suppression and damages.
