Oakland County does not require a countywide garage sale permit, but many of its cities and townships do. The City of Oak Park (Chapter 22, Article IX) requires a permit from the City Clerk before any garage sale, with a $10 fee and a state ID showing the sale address. Several other Oakland County communities — including Hazel Park, Madison Heights, Berkley, and Ferndale — require either a permit or registration. Conversely, the City of Royal Oak and the City of Farmington Hills do not require permits for garage sales held on private residential property, though both regulate signs. Oak Park's ordinance also exempts permit fees during designated "Free Garage Sale Weekends" once monthly from March through October. Sales conducted without a required permit are a municipal civil infraction with fines starting around $100.
Because the rules vary block by block in Oakland County, residents must check with the local clerk before scheduling a sale. The City of Oak Park's Code of Ordinances Chapter 22, Article IX § 22-375 et seq., defines garage sales broadly — "home sale," "basement sale," "attic sale," or any residential sale of used tangible personal property — and requires every homeowner or occupant to first obtain a permit from the City Clerk before conducting a sale. The applicant must complete the Garage Sale Permit Application, present a state ID or driver's license showing the sale address, and pay the $10 fee. Oak Park additionally allows monthly "Free Garage Sale Weekends" March through October when the permit fee is waived but all other regulations apply. Farmington Hills exempts garage and yard sales from its special-event permit (a special event permit is not required for garage/yard sales held at a private residence or subdivision commons area), as does Royal Oak — though Royal Oak still prohibits signs in the public right-of-way (between sidewalk and curb) and on utility poles, allows signs on private property only with the owner's consent, and requires removal after the sale. Several Oakland County municipalities also restrict signs at intersections under state and local right-of-way ordinances.
Holding a garage sale in a community that requires a permit (such as Oak Park) without first obtaining one is a municipal civil infraction. Typical first-offense fines are $100–$250 and the City may order the sale shut down. Repeat violations can result in higher fines and refusal to issue future permits. Posting signs in the public right-of-way (a common companion violation) is a separate infraction in nearly every Oakland County community and signs are summarily removed by code enforcement. Operating a quasi-commercial "home sale" beyond the local frequency or duration limits can trigger reclassification as an unpermitted retail use, which is a more serious zoning violation. In Royal Oak, even though no permit is required, leaving signs up after the sale or placing them on utility poles is a municipal civil infraction.
