Herndon, VA Garage & Yard Sales: Garage Sale Permits (2026)

Herndon treats casual garage sales and yard sales as incidental personal property disposal, not commercial business activity. Residents may typically hold up to 3 garage sales per calendar year per address, with each sale lasting no more than 3 consecutive days. No permit is required under this threshold. Sales must be conducted on the owner property (or with written permission of the owner for renters), cannot spill into the public right-of-way or block sidewalks, and must not create parking hazards that impede neighborhood traffic. Goods sold must be personal household items, not newly purchased inventory for resale, which would constitute retail business activity requiring a Business, Professional and Occupational License (BPOL) from the Commissioner of the Revenue. Virginia sales tax generally does not apply to occasional garage sales by private individuals (Virginia Code 58.1-609.10(6) exempts occasional sales), but dealers and those holding frequent sales must collect and remit sales tax.
