Town of Guilderland takes the same approach. However, sales that become regular or commercial in nature are treated as retail under NY Tax Law Β§1101 (sales tax registration required if selling 3+ times per year for profit) and as home-business zoning violations. NY Tax Law Β§1115(a)(18) exempts casual sales of used personal household items. Signs announcing sales must comply with each municipality's sign ordinance β Albany City Code Ch. 375 Art. IX limits temporary signs to 6 sq ft and 14-day duration, and prohibits attachment to utility poles or street signs. Removal required within 48 hours of sale end.
