Oklahoma has no comprehensive HOA act. Under the Real Estate Development Act, an owners association may levy assessments that become a lien on a defaulting owner's lot, foreclosable like a mortgage. Condominium associations get the same power under the Unit Ownership Estate Act.
The Real Estate Development Act gives an owners association power to enforce assessments "by means of a levy or assessment which may become a lien... which said lien may be foreclosed in any manner provided by law for the foreclosure of mortgages or deeds of trust, with or without a power of sale" (60 O.S. § 852(C)). Crucially, "No lien may be placed or mortgage foreclosed unless the homeowner was informed in writing" of the association's restrictions and potential financial liability when joining. The prevailing party recovers attorney's fees. Condominium unpaid common-expense assessments become a lien foreclosed "in like manner as an action for foreclosure of a mortgage" (60 O.S. § 524).
Unpaid assessments accrue as a statutory lien; the association may foreclose like a mortgage (judicially or, if authorized, with power of sale) and recover reasonable attorney's fees taxed as costs.
