Cambridge condo associations enforce master deed, bylaws, and rules through fines, lien claims, injunctions, and court action, with uniform and reasonable application required.
Under MGL c.183A and Massachusetts case law, condo trustees may enforce governing documents through written notice, fines authorized by the bylaws, suspension of common area privileges, and ultimately court action for injunctive relief. Fines must be reasonable and authorized in the bylaws; arbitrary penalties are subject to challenge. Enforcement must be uniform to avoid selective enforcement defenses. Trustees may seek injunctions in Housing Court or Superior Court to compel compliance, such as removing unauthorized modifications or stopping nuisance behavior. Unpaid fines can become part of the assessment lien. Trustees must follow any pre-enforcement procedures stated in the bylaws.
