Under 27A V.S.A. § 3-102(a)(11), a Vermont association may impose late charges and, after notice and a hearing, "reasonable fines" for violations of the declaration, bylaws, and rules. The Act sets no dollar cap, but fines must be reasonable and follow due process.
The Vermont Common Interest Ownership Act grants associations broad self-governance powers. Under 27A V.S.A. § 3-102(a)(11), an association may "impose charges for late payment of assessments and, after notice and a hearing, may impose reasonable fines for violations of the declaration, bylaws, and rules of the association." Two requirements are built in: the fine must be reasonable, and it cannot be levied until the owner has received notice and an opportunity for a hearing. The statute fixes no maximum dollar amount, so the size of any fine schedule comes from the declaration, bylaws, or duly adopted rules, bounded by the reasonableness standard. Unpaid fines become part of the association's assessment lien under 27A V.S.A. § 3-116.
No specific statutory dollar cap. After notice and a hearing, reasonable fines may be imposed under 27A V.S.A. § 3-102(a)(11); unpaid fines attach to the unit as part of the assessment lien under 27A V.S.A. § 3-116.
