Carlsbad Municipal Code does not address inflatable yard decorations - giant Santas, snowmen, pumpkins, or other inflatable displays. CMC 21.46.020 sign code exempts temporary holiday and seasonal displays. CMC 8.42 outdoor lighting addresses permanent fixtures and not inflatable LED-lit decorations. Most Carlsbad neighborhoods are governed by HOAs whose CC&Rs limit inflatable decorations in some way: typical HOA rules cap inflatable height (often 8-12 feet), require removal within 30 days after the holiday, prohibit lit inflatables after 10 or 11 PM, and may ban specific decoration types entirely. Davis-Stirling Civil Code 4710 protects 'noncommercial signs, posters, flags, or banners' but expressly excludes 'inflatable objects' from the protected category - so HOAs may regulate inflatables more strictly. Inflatables must not encroach into the public right-of-way under CMC 11.04 (Streets, Sidewalks, and Public Places), which requires a 4-foot ADA-compliant clear path on any public sidewalk. Continuous fan noise from inflatables can be cited under CMC 8.48 (Noise) if exceeding the 50 dBA nighttime residential limit.
Inflatables placed in the public right-of-way can be removed by the city and the owner cited under CMC 11.04. HOA violations carry fines capped at $100 per occurrence (Civil Code 5850) unless the board makes a written health/safety finding. Noise from inflatable fans can trigger CMC 8.48 citations.
