The City of Atlanta does not regulate the number, size, or style of decorative lawn ornaments, statuary, fountains, or religious yard displays at single-family or duplex properties through municipal ordinance. Political signs are protected as First Amendment speech and are governed by Atlanta sign provisions only for size β not content; signs in residential zones are generally permitted up to specified square footage under Code Chapter 16. Atlanta's general property maintenance and nuisance provisions in Chapter 74 (Environment) can address damaged or deteriorated ornaments only when they have become a blight condition. In Atlanta's Historic Preservation overlay districts (administered by the Atlanta Urban Design Commission), permanent visible installations β sculpture, fountains, built-in religious shrines, large permanent yard art β facing the public right-of-way may require a Type II Certificate of Appropriateness from AUDC. Temporary seasonal ornaments do not require AUDC review. HOA and condo associations retain authority under Georgia's Property Owners' Association Act (O.C.G.A. Β§44-3-220) and the Condominium Act (Β§44-3-70) to regulate exterior decorations through their declarations. Georgia's flag display protections (O.C.G.A. Β§50-3-9) and the federal Freedom to Display the American Flag Act of 2005 prevent HOAs from banning reasonable flag displays.
