NC Cottage Food Law (N.C.G.S. §106-130) allows home production of non-potentially hazardous foods for direct sale with NCDA inspection and no annual sales cap.
North Carolina has one of the more generous cottage food frameworks, governed by N.C.G.S. Chapter 106 Article 12. Approved products include baked goods, jams and jellies, honey, candies, dried herbs, and other non-TCS (non-time/temperature-control-for-safety) items. Producers must: obtain a home kitchen inspection from the NC Department of Agriculture and Consumer Services (NCDA&CS) Food and Drug Protection Division, label products with producer name, address, ingredients and allergens, and comply with NC Food, Drug and Cosmetic Act rules. Sales can be direct to consumers at farmers markets, roadside stands, and online with local delivery; interstate shipping and sales to restaurants or retailers have additional requirements. Huntersville allows cottage food production as a home occupation subject to zoning standards above. NC has no statewide annual sales cap, unlike some states that limit cottage food revenue.
