Permitted products include breads, cookies, candy, jams, jellies, granola, spice blends, and dried herbs. Meat, dairy, and refrigerated items are prohibited. Annual gross sales capped at $50,000. Producers must register with NYS Ag & Markets, label products with 'Not Subject to New York State Inspection,' and sell direct-to-consumer (farmers markets, own website, in-person). NYC DOHMH retains authority over any retail food activity outside the exemption.
Unregistered or out-of-scope production: NYS Ag & Markets fines $200โ$1,000; NYC DOHMH can issue separate citations if retail rules violated.
