Burbank Municipal Code 10-1-672 provides that a home occupation shall not create pedestrian or vehicular traffic in excess of that normal to a residential use, and bars commercial vehicles on the premises except one residential-use vehicle no longer than 22 feet and no higher than 8 feet that is used for residential purposes at least 51 percent of the time weekly. Music lessons are separately capped at ten students per day and two students per lesson.
Under Burbank Municipal Code Title 10, Chapter 1, Article 6, Division 11, the home occupation shall not create pedestrian or vehicular traffic in excess of that which is normal to a residential use of the premises (BMC 10-1-672.I). No commercial vehicle used for any part of the home occupation activity may be parked, maintained, or stored on the premises, with the exception of one (1) commercial vehicle per dwelling unit that (a) is no longer than 22 feet including any attached trailer or apparatus and no greater than 8 feet in height, and (b) is utilized for residential purposes at least 51 percent of the time on a weekly basis (BMC 10-1-672.J.1). Other than that one permitted vehicle, no commercial vehicle may be used for delivery or pickup of materials in conjunction with the home occupation, although reasonable courier services to or from the premises are permitted (BMC 10-1-672.J.2). For the music-lessons category of home occupation (BMC 10-1-672.M), additional traffic controls apply: lessons are limited to a maximum of ten (10) students per day, no more than two (2) students per lesson, with no group lessons, recitals, or concerts; lessons may occur only between 9:00 a.m. and 7:00 p.m. on a maximum of five days per week (never Sundays); a queuing location for students must be designated on the site plan; and at least one on-premises parking space beyond the residence's required parking must be provided.
Generating traffic beyond what is normal to a residence, or parking/using a non-conforming commercial vehicle, violates BMC 10-1-672. The Community Development Director may revoke or suspend the home occupation business permit after 15 days' notice under BMC 10-1-673.5.D, subject to appeal under Article 15, Title 2, Chapter 1.
