In unincorporated Adams County, a child day care home is an accessory use limited to twelve children, including the caretaker's own children under 16 not in full-day school. The facility must be state-licensed.
Section 4-03-03-02-03 of the Development Standards and Regulations regulates day care homes as an accessory residential use. Day care facilities must be properly licensed by the State of Colorado. A child day care home is capped at twelve children, including the caretaker's children under 16 who are not attending full-day school. Adequate off-road drop-off and pick-up areas are required (160 square feet per eight individuals), outdoor recreation areas need a six-foot sight-obscuring fence in the rear half of the site, and existing homes may not be significantly modified in appearance. Adult day care homes are limited to four elderly persons. Cities regulate home daycares within their limits.
Operating an unlicensed home daycare, or exceeding the twelve-child limit or other performance standards, violates both state licensing law and the county's Development Standards and Regulations.
