The Westminster Municipal Code defines 'family care home' in Section 11-2-1 as a state-licensed facility in the residence of the provider that provides less than 24-hour care, training, education, or supervision for a number of children approved and established by the state-issued license, and it requires a copy of that state license to be kept on file with the City along with a valid home occupations license. Because a family care home is treated as a home occupation, it falls under Section 11-4-10, which permits home occupations meeting the chapter's criteria in connection with the occupation of a dwelling unit within any zoning district, including residential areas of a PUD zone.

Most home occupation limits apply equally to family care homes, including the rule against a separate outside entrance, the 20-percent-of-floor-area or 300-square-foot cap on the space used, and the ban on outside signage beyond one unlit, one-square-foot wall or window sign. But Section 11-4-10(B)(5) carves out a specific exception for family care homes: while other home occupations cannot employ anyone who does not reside in the dwelling, that restriction does not apply to family care homes, allowing licensed providers to bring in outside staff. Operating without the required home occupations license, or in violation of any home occupation provision, is deemed a public nuisance under Section 11-4-10(D) and may be abated under Title VIII, Chapter 4 of the Code.
