Hemet requires a home occupation permit, issued by the Community Development Director, for each home-based business, in addition to a Chapter 18 business license. The permit carries conditions: no outside employees (except as state law allows for small family child care), no on-site customer sales except limited instruction, and the activity confined to 25 percent of the floor area.
Under Sec. 90-72(b)-(c), a dwelling may be used for business when both a business license (Chapter 18) and a home occupation permit have been issued, and a separate home occupation permit is required for each business. If the business license lapses, the home occupation permit automatically expires with it. The director may issue the permit upon application and payment of the required fee, with conditions and time limitations as needed, and may require a hearing for occupations that might not meet the section's purposes. The operating conditions in subsection (d) include: (2) employees, assistants, or volunteers who are not occupants of the dwelling shall not be employed on the premises, except as permitted by state law for Small Family Child Care Homes; (7) no customer services or sales of goods on the premises except by telephone or computer, or limited instruction (a maximum of three students per session and six students per day, with director allowances for single events); and conformity with fire, building, plumbing, electrical, and health codes. The director may impose additional conditions and may cancel the permit within 90 days if zoning is amended to prohibit the use. A permit is revoked on violation if not cured within three days of written notice; repeated violations may be revoked without further notice. Denials and revocations may be appealed to the Planning Commission (Sec. 90-43.6).
Operating without a home occupation permit, or breaching its conditions, is grounds for revocation by the director if not corrected within three days of written notice. Repeated violations may be revoked notwithstanding further notice. Appeals go to the Planning Commission.
