Tustin requires home-based businesses to obtain a city business license and complete a Home Occupation Questionnaire reviewed for zoning compliance. The questionnaire confirms the business meets the home-occupation standards of Tustin City Code Section 9297 before a license is issued.
The City of Tustin requires every business in the city, including home-based businesses, to obtain a business license through the Business License Department (300 Centennial Way; (714) 573-3144). A business operating from a residence must also complete the city's supplemental Home Occupation Questionnaire. The questionnaire asks for the type and detailed description of the business activity, residence type, square footage of the residence/work area/storage area/garage, parking impact, work activities, storage locations, business vehicles, and equipment used. It also poses yes/no questions about off-site work, spray painting, raising fish or animals, growing crops, employees (and whether all are residents), stock stored at the residence, deliveries, garage doors remaining closed during work, whether clients/customers/students frequent the residence, frequency of truck deliveries (more than twice per week), and audible noise beyond the premises. The form expressly states: 'I understand that this application and payment of tax does not license me to operate until I have fulfilled the applicable requirements of the Tustin City Code (Tustin City Code Section 9297).' The applicant declares the information true under penalty of perjury, and the city's zoning, building, water, police, and fire departments may check the business location. Misrepresentation or violating the Tustin City Code may cause the application to be denied or rescinded, and fees are not refundable.
Operating before satisfying Tustin City Code requirements, or misrepresenting answers on the questionnaire, can cause the business-license application to be denied or rescinded; fees are non-refundable. Continued non-compliant operation is subject to code enforcement.
