Section 34-4.15 of the Farmington Hills Zoning Ordinance (Chapter 34) permits home occupations as accessory uses within single-family residential zoning districts (including RA-1, RA-2A, RA-2B, RA-3, RA-4 and similar one-family districts). The activity must be conducted entirely within the dwelling unit and cannot be noticeable from the exterior of the home — no exterior storage of materials or supplies is allowed. The total area used for the home occupation, including any storage, cannot exceed fifteen percent (15%) of the floor area of the dwelling unit. Only residents of the dwelling may work on-site; no non-resident employees are permitted on the premises, and there can be no vehicles owned or operated by non-resident employees parked on or near the property. No more than one (1) client or customer may be served at a time. Any use or storage of flammable or hazardous materials must be disclosed. Operators must file a Home Occupation Registration Application with the Department of Planning and Community Development, pay a $150 non-refundable application fee plus a $75 yearly renewal, submit a floorplan, and obtain zoning approval. Fire Marshal approval is required if hazardous materials are involved. Some occupations (e.g., massage therapy) also require a separate license from the City Clerk under Chapter 16. Operations must comply with HOA covenants if applicable.
Operating without registration or in violation of Sec. 34-4.15 conditions is a zoning ordinance violation enforceable by the Zoning and Code Enforcement division. Penalties under Chapter 1 of the City Code (general penalty, Sec. 1-15) include fines and possible misdemeanor charges, plus revocation of the home occupation registration.
