Under LBMC 21.51.235, a home occupation permit is intended for home enterprises that are incidental to the dwelling use and do not change the principal character of the residence. Permitted uses include professional office activities (accounting, architecture, consulting, computer programming, legal services, marketing, writing, etc.) and cottage food operations per California Health and Safety Code AB 1616. No more than two residents of the dwelling may be engaged in the home occupation. No person other than a resident may be employed. No mechanical equipment may be used except that customarily used for household purposes. Total storage of business materials may not exceed 128 cubic feet. No toxic, explosive, or hazardous materials are permitted. The residential appearance must not be altered, and no separate entrance may be created for business use. Prohibited home occupations include auto repair, beauty salons, carpentry, veterinary services, boarding houses, tow truck service, welding, and upholstery among others.
Operating a prohibited home business or violating conditions results in code enforcement action. Administrative citations and potential revocation of the home occupation permit may result.
