El Monte Municipal Code (EMMC) Title 17 (Zoning), Division 11, Section 17.110.050 (Home Occupation Businesses) requires that a home occupation be conducted entirely within the residential dwelling structure and occupy no more than 500 square feet of floor area, including on-site storage. All home occupations require a Business Occupancy Permit (BOP) issued by the Planning Division (Planning Counter, 11333 Valley Blvd; 626-258-8626). Rental tenants must submit the property owner's written authorization. Prohibited uses include adult entertainment, commercial cannabis (except personal cultivation under EMMC Chapter 8.78), firearms sales, fireworks sales, manufacturing, munitions sales, and vehicle repairs. Activities that generate dust, glare, heat, noise, odor, smoke, traffic, or vibration beyond normal residential levels are also prohibited.
Operating a home occupation without a Business Occupancy Permit, or violating its conditions, is a zoning violation subject to administrative citations under EMMC Chapter 1.24 (Administrative Citations): $100 first offense, $200 second offense within one year, and $500 each additional offense within one year. Continuing violations may be abated as public nuisances and prosecuted as misdemeanors under EMMC §1.20.010.
