The Beason-Hammon Alabama Taxpayer and Citizen Protection Act, AL Code Section 31-13-9, mandates that all Alabama employers use the federal E-Verify system to confirm work authorization for newly hired employees. Public employers, government contractors, and subcontractors must also include sworn compliance affidavits in their bids. Birmingham businesses have no authority to opt out, and the city itself must comply for its own hiring and contracting. Federal court rulings in 2012 enjoined some Beason-Hammon provisions but left the E-Verify mandate intact.
Employers who fail to use E-Verify can face suspension of business licenses by the Alabama Department of Homeland Security and disqualification from public contracts, plus federal immigration enforcement penalties.
